What are cookies used for?

Cookies and other technologies allow a site or services to know if your computer or device has visited it before. These technologies can then be used to deliver products, services, and ads, help us understand how the site or service is being used, help you navigate between pages efficiently, help remember your preferences, and generally improve your experience in using our services. Cookies can also help ensure marketing you see online is more relevant to you and your interests.

Why does Balma use Cookies and collect data?

Balma uses cookies, pixels, local storage, and similar technologies to show you relevant content. This data is collected and analyzed to improve your experience and help protect Balma and our users. Balma may use these technologies to deliver the service, provide you with a service that is easy to use, enables you to move around the Service and use its features, such as accessing secure areas, and store information so that Balma responds faster. 

Balma may use these technologies to collect information about how you use the Service, for example which pages you go to most often and if you get error messages from certain pages. Balma may use these technologies to allow us to remember choices you make (such as your username, language, or the region you're in) and tailor the Service to provide enhanced features and content for you. These cookies can also be used to remember changes you've made to text size, font, and other parts of pages that you can customize.

Balma or our advertising partners may use these technologies to deliver advertising that is relevant to your interests. These technologies can remember that your device has visited a site or service and may also be able to track your device's browsing activity on other sites or services other than Balma. This information may be shared with organizations outside Balma, such as advertisers and/or advertising networks to deliver the advertising, and to help measure the effectiveness of an advertising campaign. Balma may use these technologies to understand, improve, and research products and services.

How long will cookies stay on my device?

The length of time a cookie will stay on your computer or mobile device depends on whether it is a "persistent" or "session" cookie. Session cookies will only stay on your device until you stop browsing. Persistent cookies stay on your computer or mobile device until they expire or are deleted Cookies that are stored by third parties will have their expiration period determined by the third party, not us.

First and Third-party cookies

First-party cookies are cookies that belong to Balma, third-party cookies are cookies that another party places on your device through our Service. Third-party cookies may be placed on your device by someone providing a service for Balma, for example to help us understand how our service is being used. Third-party cookies may also be placed on your device by our business partners so that they can use them to advertise products and services to you elsewhere on the Internet.

Changes

You can decide whether cookies are stored on your device and can choose to delete them. By accepting cookies that are stored on your device when you visit our site, we infer that you have accepted the use of cookies as explained in this Cookie Policy.

What We Collect and For What Purpose?

Personal data means any information capable of identifying an individual. It does not include anonymized data.

We may process the following categories of personal data about you:

  • Communication Data: Includes any communication that you send to us through various channels such as the contact form on our App, email, text, social media messaging, or other forms of communication.
  • Customer Data: Includes data related to purchases of goods and services, such as name, address, email, phone number, purchase details, and payment information.
  • User Data: Includes data about how you use our App and online services, and any data you post for publication on our App or other online platforms.
  • Technical Data: Includes data about your use of our App and online services, like IP address, browser details, page views, and navigation paths, collected through analytics tracking.
  • Marketing Data: Includes data about your preferences for receiving marketing communications and your communication preferences.

We process this data for various purposes including communication, record-keeping, legal claims, providing products/services, analyzing usage, protecting our business, delivering relevant content, and understanding the effectiveness of advertising.

We do not collect sensitive data such as details about your race, beliefs, sexual orientation, etc. Where data collection is required by law or contract, failure to provide requested data might impact our ability to fulfill contracts.

How We Collect Your Personal Data

We may collect data directly from you (through forms, emails) or automatically through cookies and similar technologies. We may also receive data from third parties like analytics providers, advertising networks, technical/payment/delivery service providers, and publicly available sources.

Data Security

We have implemented security measures to prevent unauthorized access, alteration, or loss of personal data. Only authorized personnel have access to your data and are required to keep it confidential.

We have procedures to address suspected data breaches and will notify you and regulators if legally required.

Data Retention

We retain your personal data for as long as necessary for the purposes collected, including legal and reporting requirements. We consider factors like data sensitivity, risk of harm, processing purposes, and legal requirements when determining retention periods.

Under data protection laws (EU General Data Protection Regulation), you have rights like access, correction, erasure, restriction, data portability, and objection. You can also withdraw consent where applicable.

At Balma, we are committed to fostering an inclusive and supportive environment for the LGBTQIA+ community. Our event listings feature is designed to provide information on LGBTQ+ events, parties, and social gatherings happening in various cities, allowing users to plan and participate in local community events and build connections within the LGBTQ+ community. To ensure that all events listed on our platform align with our values and meet the needs of our users, we have established the following Event Listings Policy:

1. Inclusivity

We welcome events that are relevant to the LGBTQIA+ community and promote inclusivity. This includes a diverse range of events such as social gatherings, parties, workshops, educational events, support groups, and community initiatives.

2. Non-Discrimination

Events promoting discrimination, hate speech, or any form of exclusionary behavior will not be accepted on Balma. We do not tolerate events that target specific gender identities, sexual orientations, or any other characteristic protected by anti-discrimination laws.

3. Safety and Security

We prioritize the safety and security of our users. Event organizers are encouraged to provide information about any safety measures they have implemented, such as security personnel, safe spaces, or accessibility accommodations.

4. Verification Process

To ensure the authenticity and relevance of events listed on Balma, we have implemented a verification process. Event organizers will be required to provide information to verify their identity and confirm the event's connection to the LGBTQIA+ community. We will review event details for compliance with our policies before approving the event for listing.

5. Community Guidelines

All events listed on Balma must adhere to our community guidelines. Harassment, hate speech, or any explicit content is strictly prohibited. Event organizers should ensure that their events foster a respectful and inclusive environment for all attendees.

6. Reporting Mechanism

We provide a user-friendly reporting mechanism that allows users to flag events that may violate our policies. Reports will be taken seriously and acted upon promptly to maintain the integrity of our platform. We encourage users to report any concerns they may have regarding event listings.

7. User Feedback

We value user feedback in maintaining the quality and relevance of event listings. Users are encouraged to provide feedback on events they have attended, helping the community make informed decisions. We may implement a rating or review system to facilitate this feedback process.

8. Continuous Review

We are committed to continuously reviewing and updating our event listings policy based on user feedback, changing community needs, and evolving best practices. We strive to ensure that Balma remains a valuable and inclusive platform for the LGBTQIA+ community.

By using our event listings feature, event organizers agree to comply with this policy. Balma reserves the right to remove or reject any event listings that do not meet the requirements outlined in this policy.

Please note that this policy is subject to change. We encourage event organizers and users to review this policy regularly to stay updated on any modifications.

The below explains how Balma and/or its parent company uses, collects, processes, and shares information, including information obtained through our website and the Balma mobile application.

What We Collect

We collect personal data and non-personal data about you. “Personal Data” means any data that allows someone to identify or contact you.

The following provides examples of the types of data that we collect, and how we collect them. Note that not all the Services collect all the data listed below. By agreeing to our privacy policy, you consent to the collection of the information indicated below. In addition to consent, the information is collected to perform a contract, to comply with obligations, or for the legitimate interests of Balma or a third party as described below. Note that some of our Services collect only some of the data listed here.

Account Credentials

We require you to provide a mobile number, email address and password for account authentication purposes to use the App or other Balma Services. 

Device Information

We collect certain software and hardware information about your Device. For example, we collect an ID that is unique to the device or browser on which you install and/or access the Balma Services (“Device ID” and “Device,” respectively).

Location and Distance Information

When you use the App, we will collect your location to determine your distance from other users (“Distance Information”) through the GPS, Wi-Fi, and/or cellular technology in your Device. Your last known location may be stored for the purpose of calculating Distance Information between you and other users.

Cookies and Log Files

We collect information from you, including your browser type, operating system, Internet Protocol (IP) address, domain name, and/or a date/time stamp of your visit. We also use cookies and URL information to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a web site. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your Device until you delete them) to provide you with a more personal and interactive experience on Balma Services and to improve our marketing efforts, including with targeted advertising. Persistent cookies we place may be removed by following instructions provided by your browser. If you choose to disable cookies, some areas or features of Balma Services may not work properly. Balma has an interest in the collection of such information for fraud monitoring and analytics purposes.

Messages

When you send a message (which could include photos, location, audio, or video) to other users, we may retain the message as necessary under applicable law.

Profile Information

We collect Personal Data from you. For example we collect information that you voluntarily provide, such as your photo, display name, relationship status, ethnicity, age or date of birth, geo-location data, mobile number, email address, password, height, weight, social network link, “Looking For,” “About Me,” “Favorites,” and any other information that you add to your profile on the Balma App or that is generated through your use of the Balma Services. You also have the option to provide information concerning health characteristics, such as your HIV status or Last Tested Date. 

HIV Status

At the recommendation of HIV prevention experts and the community of Balma users, we give you the option of publishing your health characteristics, such as your HIV status, in your profile. Remember that if you choose to include information in your profile, that information will become public to other users of the App. As a result, you should carefully consider whether you want to disclose your HIV status. We do not share HIV status with any third-party service advertisers or third-party service providers other than companies that host data on our behalf (e.g., Amazon Cloud). In addition, we do not use HIV status for advertising purposes and do not share this information with advertisers.

Purchases

We collect information necessary to complete purchases. This includes, among other things, your name, credit card information, billing information, address, telephone number, and email address.

Balma does not receive or process credit card information directly. We currently use Stripe, Google Play, and Apple for purchases on mobile devices. Please review their privacy policies at https://stripe.com/us/privacy, https://www.google.com/policies/privacy/ and http://www.apple.com/privacy, respectively, to better understand their practices.

Feedback/Support

If you provide us with feedback or contact us for support, we will collect your name and e-mail address and other Personal Data, as well as any other content that you send to us to reply and address any issue. If you contact us for support, we may also collect and retain certain technical diagnostic data, such as your phone model.

Mailing List

When you sign up for the Balma Services, we collect your email address to send you Balma news, Balma Services updates, the latest information on products and services, and third party offers.

Partner Promotion

We collect information that you provide as part of a Partner Promotion (defined below).

Third Party Platforms

If you use or connect to the Balma Site or download the Balma Services through a third-party platform, such as Facebook, you allow us to access and/or collect certain information from your third-party platform profile/account. We may also access information contained in cookies placed on your Device by the third-party platform. 

Third Party Tracking

Our advertisers also use their own cookies or other tracking technology which may collect information about you within Balma Services. We do not control the use of these tracking technologies. We prohibit them from tracking or monitoring health information (e.g., HIV status) or certain sexual group identification (e.g., Tribe).

Registration Information

When you download the App and create an account ("Account"), we may collect certain information ("Registration Information") about you, such as:

Name;

Username;

Email address;

Mobile number;

Gender identity;

Date of birth;

Sexual orientation;

Photographs;

HIV Status;

Improve Services

Communicate with you. To respond to your inquiries related to support, employment opportunities, or other requests, and to send Promotional Emails to those users that request or authorize them.

Partner Promotions

For marketing and promotional purposes, including informing you of products, services or offers of Balma, our related companies or business partners that may be of interest to you. Marketing and advertising material provided by Balma may appear within our App, on our website, on Apps owned by third parties, or on websites controlled by third parties. The marketing and advertising may relate to Balma’s products or services or may relate to the products or services of companies that have asked us to advertise to you.

Administration

For internal administrative purposes, as well as to administer or manage our relationship with you, including to communicate with you regarding your use of Balma Services.

Where We Share

In addition to the specific situations discussed above, we disclose Personal Data in the following situations:

Balma is a social networking platform designed to allow users to share information. When you use the App, your Profile Information is public, and other users of the App can see your Profile Information and other Personal Data (including sensitive personal data) posted by you. For example, other users can search for you, search for your profile characteristics, or see you listed as being in their vicinity.

You must not include information in your profile that you want to keep private. For example, if you do not want your HIV status to be known, you should not include that information in your Balma profile. While the App permits you to make certain items (e.g., Profile Information, preferences, opinions of other users, or other information) non-public, sophisticated users who use the App in an unauthorized manner may nevertheless be able to obtain this information and may be able to determine your identity.

Balma is designed to allow users to share Distance Information. As a result, Distance Information is public, and other users of the App can see your Distance Information (including how many feet or meters you are from them). Balma App users can use the search feature in the App to search for other users by distance or in a particular geographic vicinity. Your Distance Information will be used for these searches. Sophisticated users who use the App in an unauthorized manner, or other users who change their location while you remain in the same location, may use this information to determine your exact location and may be able to determine your identity. 

Third Party Tracking Companies

We share your Device ID, Profile Information, Distance Information, and demographic information with analytics partners. These third parties may also collect information directly from you as described in this Privacy Policy. The privacy policy of these third-party companies applies to their collection, use and disclosure of your information.

Third Party Advertising Companies

We share your hashed Device ID, your device's advertising identifier, a portion of your Profile Information, Distance Information, and some of your demographic information with our advertising partners. These third parties may also collect information directly from you as described in this Privacy Policy through technology such as cookies. The privacy policy of these third-party companies applies to their collection, use and disclosure of your information.

Third Party Service Providers

We share your Personal Data with third party service providers to: provide you with the Balma Services; conduct quality assurance testing; provide technical support; and/or to provide other services to Balma. Except as otherwise stated in this Privacy Policy, these third-party service providers are required by contract not to use your Personal Data other than to provide the services requested by Balma. We do not, however, provide HIV status to our third-party service providers, other than companies that host data on our behalf (e.g., Amazon Cloud).

Affiliates and Acquisitions

 We may share your Personal Data with our parent company, any subsidiaries, joint ventures, or other companies under common control. If another company acquires our company, business, or our assets, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.

Other Disclosures with Your Consent

We may explicitly ask if you would like us to share your information with other third parties who are not described elsewhere in this policy. For example, we may ask you if you would like to back-up your account, or the information stored within your local device, to a third-party back-up service such as Apple or Google cloud backup.

Other Disclosures

Balma may disclose Personal Data in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws; to establish or exercise our rights to defend against legal claims; if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, safety of person or property, violation of our policies, or as otherwise required by law.

Promotional Emails

You may choose during the registration process to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials related to Balma and/or the Balma Services, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in e-mails that you receive. If you decide not to receive promotional emails, we may still send you service-related communications, and our applications may deliver notifications directly to your mobile device in the Balma App.

Behavioral Advertising on Websites

Our websites may participate in third party behavioral advertising. This means that a third party may use technology (e.g., a cookie) to collect information about your use of our websites so that they can provide advertising about products and services tailored to your interests. That advertising may appear either on our website, or on other websites not operated by Balma. 

Behavioral Advertising Within the Balma App

If you are using Balma Services on an Apple iOS device, you can opt out of behavioral targeting by going into Settings > Privacy > Advertising on your iOS device or visiting Apple’s website for more information. To opt out on another device, open the “Google Settings,” click on “Ads” and enable “opt out of interest-based ads.”

Effect of Opting Out of Behavioral Advertising

Please note that opting out of behavioral advertising does not mean that you will not receive advertising while using the Balma Services. It will, however, exclude you from interest-based advertising conducted through participating networks, as provided by their policies and choice mechanisms.

Changes to Your Personal Data

We rely on you to update and correct your Personal Data. You can modify or delete your profile within the App. Please note that Balma may keep historical information and content in our backup files and archives as permitted by the law and to the extent we anticipate that the information may be required in connection with the original purpose of the collection, or as otherwise permitted or required by law.

Deletion of Your Personal Data

Typically, we will retain your Personal Data for the period necessary to fulfil the purposes outlined in this Privacy Policy, unless a longer retention period is required for the operation of the Balma Services or permitted by law. You can, however, request that we delete your Personal Data. All requests must be directed to the contact in the “Contact Information” section of the Balma Services. We can also decide to delete your data at any time if we believe that the data is incomplete, inaccurate, or that our continued use and storage are contrary to our obligations to other individuals or third parties. In addition, we may keep your Personal Data and usage history (which includes a history of profile text or photos that have been censored, banned) as needed to comply with our legal obligations, resolve disputes, and/or enforce any of our agreements.

Revocation of Consent

Our App relies on the processing of Personal Data that you have provided. If you revoke your consent for the processing of Personal Data, in accordance with this Privacy Policy and applicable Terms and Conditions of Service, then you must discontinue all use of Balma Services and delete any accounts that you created, as we will no longer be able to provide the services. In some cases, we may limit or deny your request if the law permits or requires us to do so, or if we are unable to adequately verify your identity.

Access to Your Personal Data

If required by law, upon request, we will grant a user reasonable access to the Personal Data that we hold about the user. All requests must be in accordance with the applicable Terms and Conditions of Service and be directed to the contact in the “Contact Information” section of Balma Services.

How We Protect Personal Information

Balma takes steps to help protect your Personal Data from unauthorized access, use, or disclosure. That said, no method of transmission over the Internet, or method of electronic storage, is fully secure, and we cannot guarantee the security of your Personal Data. If we are required by law to inform you of any unauthorized access to your Personal Data, we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Other information relating to Privacy Practice

Permissible Age

Balma Services are intended for users 18 years of age and older only (twenty-one (21) years of age in places where eighteen (18) years is not the age of majority). We do not intentionally gather Personal Data about visitors who are under the age of majority. If you are aware that a child or minor has submitted Personal Data on the Balma Services, please contact our customer support team through the Contact Us function in the application so that we can take appropriate action. 

Transmission of Data to Other Countries

Your Personal Data may be processed in the country in which it was collected and in other countries, including the United Kingdom, where laws regarding Personal Data may be less stringent than the laws in your country. Therefore, in some circumstances, you might be left without a legal remedy in the event of a privacy breach. By submitting your Personal Data, you agree to this transfer, storage and/or processing, including all associated risks.

We have no control over, do not review, and cannot be responsible for other websites or applications. If you click on a link to another website or third-party application, the terms of this Privacy Policy do not apply.

Balma will also initiate an investigation if you contact us with a complaint about our privacy practices or a concern that our practices do not conform to the requirements in your jurisdiction. We will attempt, where practical, to ensure ongoing compliance with any legal obligations.

Changes to This Privacy Policy

If we make a material change to this policy we will, at a minimum, attempt to notify you of that change either by sending an e-mail to the last e-mail address that you provided to us (if any) or by notifying you when you log into the Balma Services.

Any dispute or claim arising out of or in connection with your contract with Balma or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Contract or its subject matter or formation (including non-contractual disputes or claims).

Your UK and European (EU) rights

Under UK and EU law, UK and EU users have the right to lodge a complaint with data protection regulators, and the Information Commissioners’ Office (ICO) is the UK’s lead regulator. You can find out how to raise a concern with the ICO by visiting their website at http://www.ico.org.uk. If you’re within the EU, you may also get in touch with your local Data Protection Regulator who may liaise with the ICO on your behalf.

Balma prides itself on being a diverse and inclusive LGBTQIA+ community, we encourage freedom of speech and self-expression. The below guidelines are in place to keep our app available through the App Stores. We reserve the right to remove public profile photos, videos and text that goes against any of these guidelines at our discretion.

If you've received an alert that your profile is in violation of our content guidelines, it means that your profile may have included one or more of the subjects below. You understand and hereby acknowledge and agree to the following terms regarding profile guidelines listed below:

Nudity

No photos or videos displaying exposed genitals.

Underage

No photos or videos of anyone under 18 years of age.

Drugs

No photos or videos of illegal drugs, drug use or paraphernalia.

Offensive

No photos or videos of violent acts to yourself, someone else, or animals.

No photos or videos of guns, knives, or other weapons (real or simulated).

No photos or videos of racist, intolerant, hateful, bigoted acts, gestures, or symbols.

Inappropriate Text

No profanity or curse words, including abbreviations, masking, and fill-ins.

No text meant to threaten, intimidate, harass, defame, or insult another person.

No text that incites racism, bigotry, hatred, or physical harm of any kind.

Advertising

No advertising of services, goods, events, websites, or apps.

No advertising massage or escort services.

No phone numbers or social media handles in your profile name or text.

Conduct

We reserve the right to remove profiles at any time if they're not in keeping with our guidelines.

No Hate

We have a zero-tolerance policy toward content that promotes or condones violence, hate, or discrimination based on things like race, ethnicity, disability, age, gender identity, sexuality, nationality, or religion.

No Harassment

Behavior that is bullying, shaming, abusive, harassing, trolling, attacking or aggressive is strictly prohibited.

No Copyrighted Content

If you don't own the rights to a photo or illustration, please don't include it in your profile.

No Illegal Activity

Discussion or promotion of drug dealing, fraud, illegal sexual acts, threats, photos of drugs and/or drug paraphernalia, or anything else that’s against the law is not allowed.

No Spam

Sending messages or creating accounts for the purpose of driving members to a business or external site isn’t allowed.

What you can do

We are a community rooted in inclusivity, and we expect all our members to respect each other’s different backgrounds, lived experiences, opinions, and beliefs, and to treat others as they’d like to be treated.

If you encounter someone who’s violating the guidelines above, you can report them by tapping the report button in the top right corner of their profile and selecting Report. Our team will review the profile and take appropriate action.

If you encounter someone who has upset you but has not necessarily broken any rules, we suggest tapping the report button in the top right corner of their profile and selecting Block. You and the other member will no longer see each other or be able to communicate with each other.

External Links

Links to your Social Media profiles are allowed in the 'My Socials' section of your profile. The content of external links must adhere to the guidelines above, or they will be removed.

Balma reserves the right to add, modify or cancel eligibility requirements in its sole discretion without any notice. Employees, officers, and directors of Balma or its parent, subsidiary, or affiliated companies are not eligible to participate in the Program.

By using Balma’s Live Virtual Features, you can stream your live videos and share your emotions with the whole Balma community. Create and post in groups, publish and share as many of your significant moments as you want. You may express yourself on Balma everywhere and whenever you want: in a café, at home, outside, while listening to music or eating. You must acknowledge and adhere to the following rules while using Balma’s communication features:

Since your streams, stories, photos, etc. fall within the “Conduct Policy” definition under the Balma Terms of Service, you may not create ones which, without limitation:

  • contain obscene, pornographic, sexually (either explicit or implicit) profane, defamatory, abusive, offensive, indecent, threatening, harassing, inflammatory, inaccurate, misrepresentative, fraudulent or illegal content or actions or nudity of any kind;
  • promote racism, bigotry, violence, hatred, or physical harm of any kind against any group or individual;
  • contain hate or hate-motivated speech of any kind, especially targeted to LGBTQIA+ community;
  • are intended to, or do, harass, or intimidate any other user or third party;
  • may infringe or violate any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party, including User Content that contains others' copyrighted content (e.g., photos, images, music, movies, videos, etc.) without obtaining proper permission first;
  • contain video, audio, photographs, or images of another person without their express written consent (or in the case of a minor, the minor's legal guardian) or otherwise violate anyone's right of privacy or publicity;
  • promote or enable illegal or unlawful activities, such as instructions on how to make or buy illegal weapons or drugs;
  • violate someone's data privacy or data protection rights;
  • contain any advertising or promotional content;
  • promote Balma’s competitors;
  • are, in the sole judgment of Balma, objectionable or restrict or inhibit any person from using or enjoying the service or expose Balma or its users to harm or liability of any type; or
  • are, in the sole judgment of Balma, in violation of any of Balma’s policies.

Balma is entitled to identify the User Content as inappropriate at its sole discretion and delete/block it or make it otherwise unavailable at any time.

You will not broadcast, record, stream or otherwise create live streams as well as create any other User Content when it may present a danger to you, your friends or family or any other people.

You will not create Content intended to hurt feelings of others.

You will not stream making other people do illegal things, including, without limitations, offering, asking for, ordering, or otherwise telling them to violate any part of this Agreement.

You will adhere to this Agreement, including, Profile Guidelines and Conduct Policy.

You have no right to attempt to indicate, in any manner, that you have any kind of relationship with Balma, its parent company or that we have endorsed you or any products or services for any purpose.

It is prohibited to share a political opinion, participate in political activity, provide links to a political party’s websites, including contribution/donation page of a political party, and solicit viewers to make contributions/donations to a political party or vote for any political party while streaming.

You must not request for any charity or donation in obscene form.

You may promote your streams in any way that is not prohibited by both the applicable law and the Agreement.

We use reasonable security measures to protect your streams or their records against unauthorized copying and distribution. However, Balma does not guarantee that any unauthorized copying, use or distribution of your streams or their records by third parties will not take place.

Indemnity

You hereby release and agree to defend, hold harmless, and indemnify us, and/or our subsidiaries, parent company, affiliates, directors, officers, employees, agents, successors and assignees from and against any allegation or claim based on any loss, damage, settlement, cost, expense or any other liability (including but not limited to reasonable attorneys’ fees incurred and/or those necessary to successfully establish the right to indemnification), arising from or related to: (a) any act or omission by you, including, without limitation, any breach of the Agreement, including this Policy or allegation or claim of negligence, strict liability, willful misconduct or fraud of you; or (b) your streaming as well as creation or distribution the User Content.

Gifts

Gifts show Balma and its Members your overall contribution to the application and to the community. A user may get gifts while going live, creating User Content, communicating with other Members, getting in-app achievements, etc. Balma may encourage users to communicate with other Members and share their emotions by rewarding their efforts.. Please note that:

  • Gifts are not in-app, virtual or real objects of value.
  • A user may not interact with gifts.
  • Gifts are not a remuneration themselves; they are a representation of a user’s efforts in the application.

Members shall be responsible for and bear their own taxes, fees, costs, and expenses resulting from the negotiation, preparation, execution and performance of any documents and the transactions contemplated hereby, including, without limitation, fees and disbursements of legal counsels, financial institutions, including banks, payment systems etc.

None of the provisions stated above shall constitute:

  • Balma’s obligation to pay you a salary or any regular payments.
  • Balma’s obligation to pay you any fee, reward, remuneration, reimbursement where Balma does not directly notify you about that.
  • Your right to determine a fee amount, remuneration criteria, frequency or means of payments to be made by Balma.
  • Your right to request reward in advance.
  • Your right to dispute the amount of a reward or way it is to be paid.
  • A situation where Balma requests you to create any content or provide Balma with any services.

By posting content in public areas on Balma, you agree to abide by these guidelines and all other Balma policies. We reserve the right to remove any content, in whole or part, that violates these guidelines, our terms of service, our community standards, or for any other reason at our sole discretion.

You shall not post or send any underage material of any sort, images, or videos. If found doing so, Balma reserves the right to terminate your account without notice.

You understand and hereby acknowledge and agree to the following terms regarding prohibited conduct and uses listed below:

Balma is available for free download and use. However, we also provide additional features and services that can be accessed through optional subscription packages (Balma Unlimited) or individual paid services (such as Gifts and Tips) without a subscription requirement. 

We offer flexible subscription durations, including weekly, monthly, 3-month, and 12-month options, with occasional discounted prices for longer commitments. Please note that pricing may vary by country and is subject to change without prior notice. The app clearly displays the current prices. 

Payment will be charged to your Play Store account upon confirmation of purchase. Your subscription will automatically renew unless you disable auto-renewal at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscriptions and disable auto-renewal by accessing your Account Settings in the Play Store. 

You will not use the Balma services, or any information displayed within the Balma services to “stalk,” harass, abuse, defame, threaten, or defraud other users; violate the privacy or other rights of users; or collect, attempt to collect, store, or disclose without permission the location or personal information about other users;

You will not use the Balma services for any commercial or non-private use, such as the sale or advertisement of goods or services, and you understand that the Balma services are for personal, non-commercial use only in the manner and for the purposes that we intend;

You will not use the Balma services for the commission or encouragement of any illegal purpose, or in violation of any local, national, or international law, including laws governing criminal acts, prohibited or controlled substances, intellectual property and other proprietary rights, data protection and privacy, and import or export control;

You will not make unsolicited offers, advertisements, proposals, or send junk mail to other users of the Balma services. This includes unsolicited advertising, promotional materials or other solicitation materials, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures, surveying, or requests to participate in surveys or studies;

You will not impersonate any person or entity, falsely claim an affiliation with any person or entity, or access the Balma user accounts of other users;

You will not misrepresent the source, identity or content of information transmitted via the Balma services;

You will not remove, circumvent, disable, damage, or otherwise interfere with security-related features of the Balma services, features that prevent or restrict use or copying of any content accessible through the Balma services, or features that enforce limitations on use of the Balma services;

You will not intentionally interfere with or damage operation of the Balma services or any user’s enjoyment of them, by any means, including uploading or otherwise disseminating viruses, worms, or other malicious code;

You will not post, store, send, transmit, or disseminate any information or material which a reasonable person could deem to be objectionable, defamatory, libelous, offensive, obscene, indecent, pornographic, harassing, threatening, embarrassing, distressing, vulgar, hateful, racially or ethnically or otherwise offensive to any group or individual, intentionally misleading, false, or otherwise inappropriate, regardless of whether this material or its dissemination is unlawful;

You will not post, store, send, transmit, or disseminate any information or material which infringes any patents, trademarks, trade secrets, copyrights, or any other rights of any person;

You will not use the Balma services with any products, systems, or applications installed or otherwise connected to or in communication with vehicles, or otherwise capable of vehicle navigation, positioning, dispatch, real time route guidance, fleet management, or similar applications;

You will not use the Balma services in connection with hazardous environments requiring fail-safe performance or any application in which the failure or inaccuracy of that application or the Balma services could lead to death, personal injury, or physical or property damage;

You will not attempt to gain unauthorized access to the Balma services, or any part of it, other accounts, computer systems or networks connected to the Balma services, or any part of it, through hacking, password mining or any other means, or interfere or attempt to interfere with the proper working of the Balma services or any activities conducted on the Balma service;

You will not probe, scan, or test the vulnerability of the Balma services or any system or network; use any robot, spider, scraper or other automated means to access the Balma services for any purpose without our express written permission; bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Balma services; modify the Balma services in any manner or form; use or develop any application that interacts with the Balma services or provides access to other users’ content or information without our written permission; or use modified versions of the Balma services, including for the purpose of obtaining unauthorized access to the Balma services; and

You will not interfere with anyone’s ability to use or enjoy the Balma service, or aid or encourage any activity prohibited by this agreement.

You acknowledge that some of the Balma services may only be accessed by downloading the Balma software to a mobile device. You will not have the opportunity to view your user contents (including chat) unless you have downloaded the Balma software and registered an account.

Balma reserves the right, but has no obligation, to monitor any user’s use of the Balma services, including a user’s registration or messaging, as well as a user’s use of or access to the location information and profiles of other users. Accordingly, Balma also reserves the right to 

(a) disable any user’s use of or access to the Balma services, including the location information or profiles of other users or 

(b) terminate any user’s account, for any reason and without any notice or our being liable to you.

You alone are responsible for your involvement with other users. You agree that Balma will not be responsible for any loss or damage incurred as the result of any such interactions. Balma reserves the right, but has no obligation, to monitor disagreements between you and other users.

Balma does not control the content of user accounts and profiles. Balma has the right, but does not have any obligation, to monitor such content for any purpose. You acknowledge that you are solely responsible for all content and material that you provide to the Balma services.

To prevent and disrupt real-world harm, we do not allow any organizations or individuals that proclaim a violent mission or are engaged in violence, to have a presence on Balma. This includes organizations or individuals involved in the following:

  • Human trafficking
  • Terrorist activity
  • Organized hate / crime
  • Organized violence or criminal activity
  • Mass murder (including attempts) or sequential murder

We also remove content that expresses support or praise for groups, leaders, or individuals involved in these activities.
